Internal regulation
Article 1
In accord with the Article 12 of the association's statues, the present internal regulation aims to complete the statues. The following rules apply to members of the association.
Article 2: Values
Each member acknowledges the values of the fight against discriminations in particular those lived by LGBTQIA+ people but also the fight against all discriminations, defended by the association. Each member agrees to respect these values and to not engage in discriminatory behaviours.
Article 3: Accompaniment
In the accompaniment done by the association, each member can participate in the accompaniment, they are hence an accompanier. Each accompanier agrees to respect confidentiality, that is to not divulge personal information concerning a person they accompany.
It is still possible for the accompanier to discuss an accompanied person's case:
- by anonymising as much as possible, with another member or partner if it presents a direct interest for the accompanied person;
- without anonymising with another member or a partner with the informed consent of the accompanied person;
- without anonymising, with the accompaniment referent.
Article 4: Working in contact with youth
Each volunteer of the association who has the mission of working with youth must provide the third part of their criminal record, empty.
Article 5: Tresury
A complete account of all the revenues and expenses.
Property loans and the acquisition of property are submitted to the approval of the general assembly. Loans for functionning and investing over or equal to 2 000 euros are submitted to the approval of the administrative council.
Paragraph 1: Reimbursements
Following the acceptance of the administrative council, reimbursement of expenses (ex. transport, meals, accommodation, purchases of material...) for members can be allowed with proof, as per the following rules:
- kilometre fee costs are indexed on the relevant fiscal scheme in place at the date when the expenses were engaged.
- Reimbursements are only possible after reception of corresponding proof. An expenses sheet must be filled out by the member who engaged them and signed by the administrative council.
The association's recognition of general interest by the fiscal administration allows members to access a tax reduction for abandonned expenses from which the association benefits, upon request to the administrative council.
Article 6: Transparency
Any contract or convention signed between the association and an administrator, their spouse or loved one, are submitted to the administrative council for approval and presented for information at the next general assembly.
The financial accounts, reports and documents are accessible to all members upon request.
Article 7: Notion of writing
In the statues of the association, writing may include:
- if it is a convocation, in person by an administrator
- if it is a resignation, in person to an administrator
- sent by post
- sent by email
In the case of a convocation for a general assembly, writing includes only emails.
Article 8: General assembly
The administrators are in charge of the general assembly, however they may be assisted by non-administrator members and employees.
Article 9: Administrative council
The content of administrative councils is private and cannot be diffused.
Non-administrator referents can occasionally be present during meetings of the administrative council to report on their misisons.
The directors of establishments can be present during meetings of the administrative council if the agenda includes questions concerning the establishment they direct.
Article 10: Referents
The legal referent and the financial referent have access to the bank account, schedule expenses and can sign chèques for the association's accounts.
The legal referent and the financial referent, in accordance with the administrative council can delegate all or a part of their powers to another administrator or the direction of an establishment. Each delegation is inscribed in a document signed by both parties.
Paragraph 1: Legal referent
They represent the association in civil life and in justice, sign conventions and grant requests.
They can take the designation of President only in case of administrative need.
Paragraph 2: Financial referent
They are responsable for following the treasury of the association.
They can take the designation of Treasurer only in case of administrative need.
Paragraph 3: Employee referent
They are responsable of managing the human ressources. They participate particularly in recrutement of new employees with establishment directors.
Each year, each employee is met with the employee referent and an administrator of their choice depending on administrator availability to discuss their position.
Article 11: Losing member status
In case of non-payment of membership fees at the date of the ordinary general assembly, the member is taken off the list of members.
Resignations do not need to be motivated by the person resigning.
Article 12: Sanctions
In case of violation of the interior regulation of the association and/or of malicious or dangerous behaviour, the administrative council can pronounce sanctions for members.
These sanctions may include (non-exhaustive list):
- suspension of membership status
- ineligibility if the member was administrator and did not fulfill their obligations as an administrator
- an exclusion from the association
Prior to a sanction, the individual must be invited to appear before the administrative council to give explanations to what they have been accused of. They may be accompanied by a member of their choice.
In the case where it is impossible to meet the individual, especially due to the association's agenda or the availability of the individual, a conservatory mesure can be applied, prohibiting access to the association until a meeting can be held.
If an exclusion is considered, the invitation is sent by registered mail with proof of reception at least fourteen days prior to the date of convocation.
